Bahria Town Frustrated Over High Court Stay Order


Bahria Town Announced Frustrated Statement to Media:

Bahria Town on Wednesday, April 30, 2014 announced it has cancelled the project for the construction of flyover and underpasses it had undertaken to build in the Clifton area of Karachi.

In a frustrated media statement issued to different newspapers and TV channels, the spokesperson said right from the day one the project faced opposition and conspiracies from the negative forces, which totally ignored the interests of the people of Karachi, who were to be the real beneficiaries of the Rs1.8b project.

But the spokesperson did not reveal the motive behind constructions of that flyover and under passes that were never been of a public interest. Neither Bahria Town proved any legal format of acquisition and development process on the site.

Spokesperson also failed to prove that who was behind these conspiracies and if the DHA is involved then for what?

“Bahria Town continued its resolve to deliver the gift to the people of Karachi despite all the negative propaganda and conspiracies, a furious media statement declared.

“However, the judgment in response to a DHA application that the work on this public interest project be stopped immediately has convinced us to believe that to work honestly for the welfare of the people is the most difficult task in this country,” he said.

This statement pointed out that Sindh High Court stopped them to work with honesty

Spokesperson said the Bahria Town was dragged into the court ever since this project was initiated 45 days back and more than one stay order was issued. But they failed to explain what technical reasons enabled DHA to have such statement.

Sudden Change in Sindh High Court Version





 In a sudden, shocking and wondering move, Sindh High Court (SHC) on Friday suspended the stay order against the construction of Clifton flyover and underpass by Bahria Town.

SHC two-member bench comprising of Justice Aqeel Abbasi and Justice Zafar Rajput hearing the Bharia Town petition suspended the stay order earlier issued by Justice Munib Akhtar.

It was amazing that the decision was taken over-nightly in a suspicious way and the single bench was changed in to two members bench without explaining its reasons.

During the hearing, Bahria Town lawyer made a plea that the area in question falls under the jurisdiction of Karachi Metropolitan Corporation and, as such, Defence Housing Authority (DHA) petition against the construction of Clifton flyover and underpass was illegal, while according to law preparation of environment affects of this project was not mandatory.

Later, the court suspending the stay order adjourned the hearing until April 22.

Mr Aziz Suharwardi : Vice President: Cantonment Board Clifton (CBC) Karachi , claiming that all environmental and building laws were violated by Bahria Town Icon management, he expressed his strong note of protest and said non of DHA and CBC were taken into confidence while launching this mega project. Mr. Suharwardi said CBC will not let its residents being affected in this situation.

Honorable Sidh High Court issued notices to Bahria Town and Environmental Protection Agency (EPA) Karachi Metropolitan Corporation (City Government) Karachi against the construction of a multi-storey building named Icon Tower Bahria Town Karachi on Clifton beach, petitioner Begum Farkhunda Ahmed filed her petition on behalf of residents of Clifton and DHA.

Nobody has objection over Pakistan's tallest mega tower with 62 storeyes, the concern is that no proper environmental and building control including town planning measures were taken while erecting such building that kept million of residents of Clifton, DHA, Neelam Colony, Shah Rasool Colony etc.
